PRIVACY STATEMENT BRABANTDC COMMUNITY AND WEBSITES, OPERATED BY NORTH BRABANT PROVINCE
This privacy statement applies to any visitor of the BrabantDC Community and the websites www.BrabantDC.nl and www.CWF2019.com. By ticking the box you agree to the use of your personal data as specified in this privacy statement.
Article 1 Definitions
BrabantDC operates an online platform, called the BrabantDC Community. The Community is a platform on which people, companies and organisations can communicate, collaborate and share content on topics concerning creativity and imagination in relation to social challenges in the broadest sense.
BrabantDC processes various (personal) user data to facilitate the functioning of the Community and has a responsibility to uphold the General Data Protection Regulation. This privacy statement applies to all personal user data processed by or on behalf of BrabantDC.
Personal data are all data relating to an identified or identifiable natural person.
Non-personal data are data that BrabantDC processes on an anonymous and aggregated level for historical and statistical purposes.
Processing of personal data includes any action or group of actions relating to personal data, including collecting, recording, organising, storing, updating, modifying, retrieving, consulting, using, providing by means of forwarding, distribution or any other form of making available, compilation and connecting, as well as the protection, deletion or destruction of data; both the collection and the processing of personal data.
Article 2 Purpose of processing personal data
BrabantDC processes the personal data of Community users for the following reasons:
for the proper functioning and improvement of the Community and the services and functions we provide to you and other users;
to send you newsletters, invitations and other notifications about BrabantDC and CWF2019;
to make you offers of services from BrabantDC;
to comply with legal obligations.
By granting us permission to use your personal data for these purposes, you not only make it possible for us to continue offering the Community in its current form, but also to develop innovative features and services that use the information we receive on you in new ways.
Article 3 Which personal data are processed by us
3.1 BrabantDC processes the following personal data if you make use of the Community and our websites www.BrabantDC.nl and www.CWF2019.com:
- Your registration details: the data we request that you enter when you register for the Community or for one of our events, such as name, e-mail address, telephone number, organisation name and social media accounts. The e-mail address that you provide may be used to send a welcome message and account-related e-mails.
- Data that you share with others. You can share data via the Community. This may include:
- your name, organisation, social media accounts, information, images and files that you upload to your account;
- Data that you make public when you communicate via the Community. This includes:
– the uploading of a case, challenge or inspiration;
– the uploading of an event;
– the uploading of associated image material;
- Other information on you that we process. This involves the following information:
- tracking cookies, which we use to process your preferences, your visit and your use history on the Community, based on which we make offers of products and services from BrabantDC.
- data that are necessary to make use of the Community and our websites and to improve the Community and websites service provision, including but not limited to your Internet Protocol (IP) address.
3.2 The following types of data are public on the Community and will be handled in the same way as data that you make public yourself:
- Profile photo

- Social media details
- Content that you have uploaded to the Community
better inform you of news, our events, challenges, inspirations and other information;
to carry out analyses for research purposes;
to maintain our relationship with you, as a member of our network.
4.2 You can delete all cookies on your computer or disable them. You do this by adjusting the settings of the internet browser. Please bear in mind that if you turn off cookies, certain functionalities may no longer work properly on your computer. If you have set up your browser or mobile device in such a way that cookies are not accepted, certain parts of the Community may not function properly. You may no longer be able to log in, for example.
If you would like to block, delete or be notified about cookies, please consult the instructions in your browser.
Article 5 Provision of personal data
5.1 BrabantDC will not make public, sell and/or trade the personal data of users of and visitors to the Community, unless it is explicitly otherwise permitted in this privacy statement, such as in Article 3 paragraph 2.
5.2 BrabantDC may use a third party for the processing of personal data, referred to as a processor. BrabantDC has concluded a processor agreement with this party.
5.3 The user acknowledges and accepts that if they use the functionalities of the Community, and/or environments, forums or other interactive parts of the Community, or share information with individuals by making use of the Community, this information is available to other users of the Community. BrabantDC is not liable for the actions of third parties, such as other users with whom you have shared information.
Article 6 Links to third-party websites
6.1 The Community includes links to other third-party websites. BrabantDC has no control over the activities of such websites or third parties.
6.2 (Personal) information that you provide on the pages to which we include links is made available directly to the third party and is subject to that third party’s privacy statement. BrabantDC is not liable for the content, privacy, security and regulations of the websites to which BrabantDC provides links. These links to third-party websites are only included for the convenience of users. We recommend that you familiarise yourself with the third party’s privacy arrangements, security and regulations before you provide them with (personal) information.
Article 7 Push notifications and local notifications
7.1 BrabantDC may, with your explicit permission (opt in), send you push notifications to inform you of updates to the Community or the services of BrabantDC, or provide you with relevant messages.
7.2 You can adjust the push notification settings on your mobile device or computer by consulting the settings.
Article 8 What measures does BrabantDC take to protect your personal data?
8.1 BrabantDC takes appropriate technical and organisational measures to protect personal data against loss or any form of unlawful processing. These measures guarantee, taking into account current technological standards and the costs of implementation, an appropriate level of security in view of the risks involved in processing personal data and the nature of the personal data to be protected.
8.2 Access to the data stored on the BrabantDC servers is secured via a username and password. The servers are also located in a secure environment. The servers themselves – both physically and the data on them – are secured.
8.3 Internal access to personal data is restricted to employees who need access to those data to perform their tasks. Unauthorised access and unauthorised use of personal data by employees are grounds for disciplinary action against the employee in question. Furthermore, our information management system is configured in such a way that personal user data are closed to employees that do not have the required access rights, which are linked to their duties.
8.4 The user acknowledges and agrees that the BrabantDC Service Providers may be responsible for processing and recording some of the personal data we receive. These Service Providers are contractually bound to secure the personal data they receive from BrabantDC and to store them securely. Although we strive to protect your personal data, you acknowledge and accept that sending information via the internet is not necessarily secure and may be intercepted/received by third parties. Therefore, we cannot guarantee the security of that information and we are not liable in cases where a third party intercepts and/or receives your information.
Article 9 Unsubscribe
9.1 If you no longer wish to receive marketing and promotional messages or general news items via e-mail, you may unsubscribe (opt out) by following the instructions included in each e-mail or by sending a message to email@example.com. We will comply with your request within a period of 14 days from its receipt.
9.2 The information stated in paragraph 1 of this article does not affect our right to use and continue using your e-mail address to send e-mails regarding the use of the Community and your user account, or to use your e-mail address in any other way as described in this privacy statement.
9.3 If, at any date, you choose to have your e-mail address removed from our mailing lists, you may request this by sending a message to: firstname.lastname@example.org. We will comply within a period of 14 days from receipt of your request.
Article 10 How can you view, update, correct or delete your personal data?
10.1 You may view the personal data that we have collected on you by sending a request to: email@example.com. We will respond to such a request within a period of 14 days.
10.2 We are entitled to request that you provide proof of your identity before granting you access to your personal data. We reserve the right to deny access to the personal data until we believe that your identity has been determined with sufficient certainty.
10.3 Please note that certain types of personal data, which are necessary to verify that you are eligible to make use of the Community, cannot be deleted unless you delete your user account. Among others, this includes your name. Please note that deleting certain personal data may result in your user account being terminated and you will no longer be able to access the Community.
10.4 We reserve the right to store your data in our files, if this is necessary technically, legally or for the benefit of our services.
10.5 If you have objections to the use of your (personal) data as described in this privacy statement, you should not use the Community.
Article 11 Storage period
11.1 The personal data will be deleted within three months of you terminating your user account, unless a legal retention period takes precedence.
11.2 Data from use of the Community may still be processed for historical and statistical purposes after termination of your user account, but only at an aggregated level.
Article 12 Final provisions
12.1 BrabantDC has the right to change the provisions of the privacy statement. If substantive changes are made, users will be informed via the Community and newsletters. Furthermore, users will be asked to approve the changes to the privacy statement by ticking a box. If the user does not agree or intend to agree, their user account will be blocked and/or suspended by BrabantDC. The most recent version of the privacy statement can be viewed at any time via www.brabantdc.nl.
